Let me tell you this and then I would like your comments and advice.We live in TN One of my daughters had a child tell her she had been severely abused and got my daughter to run away with her. Judge Ross (Wayne County we live in Perry) signed the order today(4/12/02) for her to come home on May 31st in state's legal custody for 30 days then on After Care (basically her file stays open for 30more days) The kicker-- he told me to be prepared for him to not allow me to homeschool her any longer because psychologists agree/say that they need to go to public school to learn things other than academics such as social skills, how to handle peer pressure, etc.!!!! We are not members of HSLDA but as they are asking for such cases on their website I called. They said they would get back to me on Monday. (That would have been 4/15 as of this writing they have not contaced me back) They did say that even though we do not live in that Judge's jurisdiction and school does not open for about a month after she is out from under the state, he can make this ruling. My daughter is gifted. The DCS worker told the Judge that she could not get music instruction at home she needed to attend public school to participate in band--Perry County does not offer music, choral or band. I taught her piano, music reading and flute, my husband taught her guitar, saxophone and drums. The director at her Placement-- Madisonville Group home has told her and indicated to my husband that I am not intelligent. I have never met this lady nor have we ever communicated in way at all. i have submitted to testing by State psycologists and all that testing says I am very much an intelligent person. She has also stated she does not agree with our lifestyle. (We prefer to live plain and simply growing our own food, etc. However we do not live that way att he moment and have not for 2+ years) If anyone on this board can offer me any help, it would be greatly appreciated. I don't know of many lawyers who work cheaper than that. Also, this what HSLDA specializes in: home schooling and education law. The organization exists for that purpose, and its lawyers are generally home schooling their own children. I don't think there are so many attorneys specializing in education law (not much money in it), but you may be sure your local school district will have on retainer whoever does do education law in your location). Don't go into a courtroom with these sharks (your local educrats) without an attorney who specializes in education law! Believe me -- I know what I am talking about. Try Nolo Self-Help Law at www.nolo.com. Try calling the American Bar Association for a referral. The fee for the first consultation with a lawyer is usually low. Many lawyers do some pro bono work, so it might be possible to find one who would represent you without charge. You have to be a member of HSLDA before they will offer any advice (legal or otherwise). Join it PRONTO! You can, however, get some idea of your state's laws through HSLDA's web site (http://www.hslda.org). I assume you notified your local school district of your intention to homeschool your child? When we did so, I wrote a letter to our local district stating that we wanted a "Christian education" for our child (which is every parent's right -- likewise if you want a Jewish, Muslim, or any other religious education). Since the public schools cannot, by law, offer that, they generally don't want to tangle with it (and legally, they can't). You may need to enroll your daughter in a Christian school (and you don't necessarily have to remain there). It sounds like you have ruffled some feathers of your local educrats, and perhaps you live in a small community. In areas where school overcrowding and violence are big problems, they generally leave you alone, as they are already up to their necks in rattlesnakes. Just pay your taxes, and they don't care what you do (unless you anger some local True Believer in the Public Schools). And for God's sake -- don't demean yourself by subjecting yourself to any more psychological tests to prove your own intelligence, validity, or parental rights. Spit in their eye! I am sorry about your dilemna. please let us know what happens. I wonder if you sign up with a 600 school? or maybe they are called umbrella schools? there is an enrollment fee and you have to send in monthly attendance. But you are still homeschooling the way you choose for the most part. That way the school district deals with them, most I believe are "christian private schools" but no one really has to know if you are not. Let me add a few details: I have contacted HSLDA. They said the Judge can issue such an order, even though she will be out of the State's system/custody about 45+days when school starts and we do not live in the jurisdiction of that judge. In TN you can register with a CRS. We are registered with one (Christian one). When you do this according to Kaye Jeter, Legal Counsel for TN--if you are registered with a CRS your students are private school students being taught in a sattellite classroom. (http://www.tnhomeed.com/Jeter.html#Jeter) It is my experince that Judges issue orders similar to "Minor Child will attend public school while in parent's custody" Money is a definite issue here. Also lifestyle. In the past we have a quasi homesteading lifestyle and we are planning to return to it ASAP. We have friends that are Plain and the State is thinks they are Amish and Mennonite due to there mode of dress. The State is very scared we will join one of the local communities. (Have no intentions of that) They have described me as "primitive" No one can figure that one out. I do enjoy visiting my Plain friends and family, it is a very peaceful and relaxing experince. I can assure you I have all the amenities and enjoy them, but yes, I could easily live without any of them (except my computer hee-hee) Replying to: Sad but not really surprising.
